I am buying a flat (leasehold 138 year). Which is currently on shared ownership and repossessed by bank and bank is selling it. Seller is also doing the final staircasing on completion. Which means on completion my solicitor has to do 2 registry and merge the title. My solicitor is asking seller’s solicitor to give the undertaking to provide all staircasing document on completion so he can proceed with required work and seller has refused to give that. But have mentioned that in contract that they are responsible for the final staircasing and pay any arrear to freeholder.

Its in a deadlock and not moving ahead. My solicitor will not proceed without undertaking . what I should do ? I am buying with mortgage.

Are you sure you want to be involved in all that? I would probably look for something else and don't waste my time on that. That is only my opinion, cause i am s busy these days. I even decided to hire academic writing services https://academized.com/ and ask them to help me with the studies. All that sounds way too complicated and you need to waste lots of your energy in that.

Look for another property !

Solicitor not giving undertaking and fact arrears paid to freeholder has alarm bells all over it.

Seller defaulted, you are buying from bank, seller doing work, seller responsible to freeholder for work.

If the seller cannot afford to keep the property, and thus he is likely, if not already bankrupt, then what makes you think he has any interest in doing any work let alone provide an undertaking. If he does, then you will be another in the queue to sue him.

It's an old thread, resurrected by Lex. Personally, I wouldn't buy leasehold.

I'm sorry to hear that you're in a deadlock with the seller's solicitor. I would recommend speaking to your solicitor again to get their advice on the best course of action. If you decide to proceed without an undertaking, be prepared for the possibility that the seller may not provide all of the necessary staircasing documentation on completion. This could delay your purchase and incur additional fees. If you're not comfortable proceeding without an undertaking, try negotiating with the seller's solicitor to see if a compromise can be reached.
