Are you liable for your spouse's care fees?

Here is a question posed to me by a relative. He believes that his wife will have to go into care in the near future, this means that care fees will be assessed on how much money she has. They live in a rented apartment so no house to sell. The question is "what about the situation where they have money in separate ISAs?" does the assessment in this case include the husband's money as well?

As far as I know the answer is no, but if, for example, the wife withdrew money from her ISA and put it in her husband’s ISA this could be considered as deprivation of assets in which case any money transferred would still be counted as hers.

Even if they owned their home, as long as a partner (spouse, etc) is living there, then the home is not assessed for care home fees.

AFAIK the spouse's assets are also not included in the assessment.

However, I would suggest you contact Age Concern on their free advice line:
0800 678 1602. Lines are open 8am-7pm.

Alternatively contact your local Citizens Advice Bureau, but their lines tend to be very busy so Age Concern would be a better bet.
